Client Privacy, Image Usage & Confidentiality Policy

Photoklicker Photography — Dehradun, Uttarakhand

At Photoklicker Photography, we respect the privacy, dignity, and personal boundaries of our clients. We understand that photography sessions, particularly pre-wedding, engagement, wedding, and portrait sessions, may involve personal moments that clients wish to keep private.

We are committed to handling client photographs responsibly and maintaining appropriate safeguards for the photographs entrusted to us.

1. Client Privacy and Confidentiality

Photographs created during a photography session are handled in accordance with the agreed services, applicable permissions, and our privacy practices.

We do not intentionally publish or disclose private client photographs for promotional, commercial, or public purposes without the appropriate authorisation, except where disclosure is otherwise permitted or required by applicable law.

Clients who require additional privacy arrangements are encouraged to communicate their requirements before the photography session.

2. Intimate and Personal Photography

We recognise that pre-wedding, engagement, and portrait sessions may include romantic poses, embraces, kissing, or other personal moments.

Clients may communicate their privacy preferences before or during the session. Our team will handle such photographs with discretion and restrict their use to the purposes agreed with the client.

Photographs intended to remain private will not knowingly be used in our portfolio, advertisements, social media publications, or other promotional material without the appropriate permission.

3. Photograph Selection and Digital Delivery

For convenience, Photoklicker Photography may provide photographs through online galleries, cloud storage services, or other digital delivery methods.

Clients should be informed of the access arrangements applicable to the delivery method used.

Where a gallery or folder is accessible through a shareable link, anyone who obtains that link may be able to access the photographs, depending on the platform’s permissions and security controls.

Clients should avoid forwarding access links to unauthorised persons. Where technically available, access restrictions may be used to limit viewing to designated recipients.

We will take reasonable measures appropriate to the circumstances to protect photographs under our control. However, no online storage or transmission method can be guaranteed to be completely secure.

4. Restrictions on Unauthorised Disclosure

Client photographs must not be knowingly disclosed, published, sold, distributed, or otherwise used by Photoklicker Photography or its authorised personnel outside the agreed purposes without appropriate authorisation, unless disclosure is permitted or required by applicable law.

Clients who receive digital copies are also encouraged to respect the privacy and consent of everyone depicted in the photographs before publishing or forwarding them.

Nothing in this section limits any person’s rights or obligations under applicable law.

5. Portfolio, Marketing and Social Media Use

Photoklicker Photography may wish to showcase selected work through its website, portfolio, social media accounts, advertisements, or other promotional channels.

Where a photograph requires client permission for such use, we will obtain the appropriate authorisation before publication.

Permission to photograph a client or provide photographs for album selection does not, by itself, constitute permission to publish those photographs for promotional purposes.

Clients may discuss specific restrictions on the use of their photographs with us.

6. Reporting a Privacy Concern

If a client believes that their photographs have been accessed, disclosed, or circulated without authorisation, they should contact Photoklicker Photography through our official contact channels.

Where possible, the client should provide:

  • A description of the photographs concerned.
  • The approximate date and circumstances of the suspected disclosure.
  • Screenshots, links, or other available evidence of the publication.
  • Information about where the photographs appeared and how the client became aware of the incident.

We will review the information provided, take appropriate steps within our control, and cooperate with lawful requests where required.

Where appropriate, we may restrict access to the relevant gallery, review available access records, or take other reasonable measures to help contain the incident.

Restricting access to an original gallery cannot guarantee the removal of copies already downloaded or redistributed by third parties.

7. Security and Access Controls

We aim to use reasonable measures to protect photographs stored or handled through our systems and service providers.

Access to photographs should be limited to authorised persons who require it for legitimate business purposes.

Where a potential security incident is identified, we may take appropriate steps to secure access, preserve relevant records, investigate the circumstances, and determine whether further action is required.

The availability of access records and the ability to identify particular viewers may depend on the capabilities and limitations of the relevant service provider.

8. Third-Party Platforms and Unauthorised Distribution

Photographs may be stored or delivered through third-party services, including cloud storage and online gallery platforms.

Those services operate under their own technical arrangements, access controls, and applicable terms.

If photographs appear on an unauthorised website, social media account, or messaging platform, we may review the available information and, where appropriate, assist with reporting the material to the relevant platform or competent authority.

Our ability to identify the person responsible for a disclosure or remove copies distributed by others may be limited by the available evidence and our legal authority.

9. Questions, Complaints and Privacy Requests

Clients who have questions about the handling, access, or permitted use of their photographs may contact Photoklicker Photography through the contact details published on our website.

We encourage clients to report privacy concerns promptly so that the relevant information can be reviewed and appropriate action considered.

Requests concerning access, retention, or deletion of photographs will be assessed in light of the circumstances, applicable contractual commitments, legal requirements, and any legitimate need to preserve relevant records.

10. Applicable Law

This policy is intended to explain our approach to client privacy and responsible image handling. It should be read alongside the applicable service agreement, privacy notice, and other relevant terms.

Nothing in this policy excludes or restricts any rights, remedies, or obligations that cannot lawfully be excluded or restricted under applicable Indian law.
